AS 3745:2010 was written for buildings with stable occupancy. The chief warden knows the staff, the staff know the building, and the emergency planning committee can build procedure around a known cohort. Shared kitchens, cloud kitchens, and multi-operator coworking spaces break that assumption. The occupants change daily, sometimes hourly. New operators arrive who have never set foot in the building, set up their station, run a six-hour shift, and leave. The next operator takes the same station that evening with no handover briefing.
The compliance question is not whether AS 3745 applies (it does), but how it applies when the cohort rotates faster than the warden register can be updated. This post covers the multi-operator shared-facility variants common in Australia, who carries the duty of care, what changes in the diagram and procedure, and the operating patterns that hold up at audit.
The shared-facility taxonomy
Multi-operator shared facilities in Australia run in several common shapes. The compliance pattern is similar across all of them, but the food and fire risk profiles differ.
- Cloud kitchens (also called ghost kitchens or dark kitchens). One commercial kitchen space subdivided into multiple delivery-only food brands. Operators may share the kitchen simultaneously or rotate by shift. No dine-in customers; the only occupants are staff and delivery riders.
- Commissary kitchens. Rentable commercial kitchen space used by caterers, food trucks, small food manufacturers, and meal-prep businesses. Operators book by hour or day, bring their own ingredients, and use shared equipment.
- Shared production studios. Coworking arrangements for bakers, chocolatiers, sauce makers, and small-batch food producers. Often paired with a commissary kitchen but with dedicated bench space.
- Multi-tenant warehouse and logistics flex. Single warehouse subdivided into demising walls or open zones for multiple small logistics, e-commerce fulfilment, or light-manufacturing operators.
- Coworking fitness and studio spaces. Pilates studios, dance studios, yoga rooms, and recording studios subletting time slots to multiple instructors or independent operators.
- Multi-tenant retail kiosks and food halls. Permanent multi-stall spaces (eat streets, market halls, food courts with separate kiosks) where each operator runs an independent micro-business inside a shared building envelope.
Each variant lives between two existing post angles: the coworking spaces post covers traditional desk-and-meeting-room coworking, and the food manufacturing and commercial kitchens post covers single-operator food production. The shared kitchens and multi-operator pattern sits in the middle, picking up the rotating-tenant complexity from coworking and the elevated fire-risk profile from commercial kitchens.
Who carries AS 3745 duty of care
In a multi-operator shared facility, AS 3745 compliance and the WHS general duty are shared across the operator hierarchy, but the principal weight sits with the facility operator (the entity running the building, holding the head lease, or owning the freehold).
- Facility operator. Owns the AS 3745 emergency plan, the diagrams, the warden register, the Emergency Planning Committee, the drill program, and the fire equipment maintenance schedule. The PCBU duty of care for everyone on site.
- Sub-tenant operators. Carry the WHS duty for their own staff and contractors, including induction into the facility emergency procedure. Cannot delegate the AS 3745 facility-level obligations to themselves; their obligations layer on top of the facility operator obligations.
- Casual or hourly users (caterers, food truck operators using a commissary, instructors hiring a studio for a class). Treated as occupants under AS 3745 and as workers under WHS for the duration of their booking. Their induction is the facility operator responsibility, not their employer responsibility, because most casual users are sole traders without a separate PCBU upstream of them.
- Delivery riders, couriers, customers attending a class, students of a workshop. Standard occupant treatment under AS 3745. The facility operator emergency procedure must accommodate them.
The clearest way to draw the line: anything that requires reference to the building diagram, fire equipment, or assembly area is the facility operator obligation; anything that involves a sub-tenant employee specifically (their PEEP, their personal training records) is the sub-tenant obligation. Both layers should be documented; both layers should be auditable. The Emergency Planning Committee should include sub-tenant representation if the cohort is stable enough to make that practical.
The rotating-occupant problem
Standard AS 3745 emergency planning assumes that occupants know the building. The warden briefing, the assembly area location, the route from a workstation to the nearest exit, all of these are familiar to staff who arrive every day. Shared facilities subvert this assumption in two ways.
- Frequency of new arrivals. A commissary kitchen may host 30 to 50 different operators across a month, with a baseline of 5 to 10 they have never seen before. A cloud kitchen rotates faster. A coworking studio rotating instructors hourly may see 100 unique users per week.
- Familiarity gap. New operators arrive focused on their booking (cooking, teaching, fulfilling orders). Emergency procedure is rarely top of mind. They will not stop to read a wall-mounted diagram unless something forces the read.
- Multilingual cohort. Cloud kitchens and commissary kitchens often have crews where English is a second language. Diagrams that rely on text labels (rather than ISO 7010 pictograms) leak comprehension at the worst moment.
- Out-of-hours patterns. Many shared facilities run beyond standard hours. A meal-prep operator at 4 AM in a commissary kitchen is operating under conditions closer to lone-worker or after-hours scenarios than to standard occupied-hours.
Out-of-hours operations specifically overlap with the lone worker and after-hours guide from earlier in this post sequence. A shared kitchen booking at 4 AM is functionally a lone-worker shift, even though the formal staffing structure is different.
Diagram design for multi-operator readers
A shared-facility evacuation diagram has to be readable by an occupant who has never seen it before, while they are stressed, possibly under English-as-second-language pressure, and in a part of the building they may have only entered once. Design choices that hold up.
- ISO 7010 pictograms throughout. Text labels in English plus the dominant working languages of the operator base if known. Pictograms carry the bulk of the meaning; text supports comprehension for those who read it.
- Floor plan oriented for the most common entry direction, not the building owner architectural orientation. New operators read the diagram from where they stand at the entry, not from above.
- You-are-here indicator at every diagram mount point, with the indicator referenced to the actual physical position of the diagram (not the lobby front desk position).
- Primary and alternative exit routes both shown. Single-exit reading is the most common after-hours emergency failure mode; multi-operator facilities mostly run after-hours.
- Assembly area direction shown clearly, with the assembly area photograph or a description on the diagram if it is not visible from the building exit.
- Fire equipment locations relevant to the kinds of fire likely in this facility (cooking suppression for commercial kitchens, electrical for studios, plant-room for warehouses).
- Diagram mount points include locations operators actually use, not just the visitor lobby. In a commissary kitchen, every prep station should have line-of-sight to a diagram; in a logistics warehouse, every loading bay should.
Induction patterns for sub-tenants
Sub-tenant induction is the operating control that closes the rotating-occupant gap. The induction needs to happen every time a new operator arrives, not just at the start of a multi-month sub-lease. Three patterns are common in Australian shared facilities.
- On-arrival walkthrough. Facility operator staff member walks each new sub-tenant through the building once, pointing out exits, diagram locations, fire equipment, assembly area. Takes 5 to 10 minutes. Suits commissary kitchens and shared studios with a small staffing footprint.
- Video induction with sign-off. New sub-tenant watches a 3 to 5 minute video covering the same content, then signs an acknowledgement. Suits cloud kitchens and high-rotation facilities where on-arrival walkthrough does not scale.
- In-app induction at booking confirmation. Booking platform sends the induction content as part of the confirmation email; sub-tenant must complete the induction quiz before the booking unlocks. Suits coworking studios and per-hour rental contexts.
All three patterns require a sign-off record kept by the facility operator. The induction records are part of the WHS documentation set and are commonly the first item a regulator asks for after an incident. The minimum data per induction record: sub-tenant name, business name (if applicable), date, version of the induction content delivered, and acknowledgement.
Drill program for rotating cohorts
AS 3745 requires evacuation exercises at least annually with all occupants where practicable. In a shared facility, "all occupants" is a moving target. The workable approach treats drill participation as a mix of scheduled drills with sub-tenants present and walkthrough simulation during induction.
- Quarterly main drill with whichever sub-tenants are on site that day. Documented as a standard AS 3745 drill, with the cohort recorded as a snapshot rather than a stable roster.
- Induction simulation as a partial drill credit. The on-arrival walkthrough or video induction includes a simulated walk through to the assembly area. Documented per sub-tenant.
- Tabletop drill with the facility operator core team and any long-term sub-tenants quarterly, covering scenarios specific to the facility (kitchen fire, equipment failure, after-hours alarm response).
- Scenario-targeted drills annually for the highest-likelihood incident type at this facility (commercial kitchen fire suppression for a cloud kitchen, partial collapse for a logistics warehouse, lockout for a high-foot-traffic studio).
The drill report should record both the standard cohort drill and the cumulative induction-simulation participation across the year. Both feed the EPC review. Equipment list reconciliation
Multi-operator facilities introduce a fire risk variable that single-operator buildings do not face: each sub-tenant brings their own equipment, and the equipment list at any given moment is different from the list yesterday. The fire safety risk picture is dynamic.
- Operator-supplied equipment register at booking. Sub-tenants declare what they bring (portable ovens, blowtorches, induction cookers, sound equipment with high-draw amplifiers, charging stations for delivery e-bikes).
- Approved equipment list at the facility operator level. Defines what is permitted on site without prior approval; anything outside the list requires sign-off and may trigger an additional fire safety review.
- Periodic facility-side audit of installed equipment. Catches equipment that arrived without declaration or remains on site after the booking ends.
- Charging station discipline. E-bike, scooter, and battery charging stations are a growing fire risk at cloud kitchens and food halls; the facility operator should designate a specific charging zone with appropriate suppression coverage and signage.
The equipment list reconciliation is also relevant to AS 3745 and the underlying mixed-use building compliance posture. Mixed-use complexity scales with operator count; a multi-operator building with 20 sub-tenants is functionally a mixed-use occupancy even if the building classification on the development approval is single-use.
Lease and occupant agreement clauses
The compliance distribution between facility operator and sub-tenants should be explicit in the lease, sub-licence, or per-booking terms of service. Vague distribution is the most common audit finding when a regulator inspects a shared facility post-incident.
- Facility operator responsibilities. AS 3745 plan, diagrams, EPC, warden register, drill program, fire equipment maintenance, induction delivery and recordkeeping.
- Sub-tenant responsibilities. Equipment declaration at booking, induction completion before the first booking, compliance with on-site emergency procedure, reporting of incidents or near misses, briefing of sub-tenant own staff on the facility procedure.
- Mutual obligations. Joint cooperation in drills, sharing of incident reports, and prompt notification of layout changes (sub-tenants may install temporary partitions or rearrange storage that affects exit clarity).
- Termination triggers. Repeated equipment-list breaches, induction-completion failures, or drill-participation refusals as grounds for booking termination, both per-booking and at the master sub-licence level.
Multi-shift and after-hours coverage
Shared facilities frequently run multiple shifts per day and overnight. The diagram and procedure must function under each staffing condition.
- Daytime peak. Multiple sub-tenants on site, full warden cohort, standard occupied-hours procedure applies.
- Evening shift. Reduced sub-tenant count, reduced warden cohort, often a single facility operator staff member on site as duty manager.
- Overnight or pre-dawn. One or two sub-tenants on site, no facility operator staff except via on-call, lone-worker scenario applies.
- After-hours emergency assembly. The daytime assembly area may be inaccessible (gates locked, cordoned shopping centre car park); after-hours assembly point should be on the diagram with after-hours conditions clearly noted.
- Out-of-hours alarm response. Facility operator on-call procedure, including who attends, in what timeframe, with what access credentials.
Multi-shift coverage interlocks with the lone-worker scenario; a single sub-tenant operating overnight in a commissary kitchen is operationally a lone worker, regardless of whether they technically have an employer who counts them as a remote worker.
State variations
AS 3745 is national, but shared kitchens and food-related facilities pick up additional state and local-council requirements that other coworking variants do not.
- NSW. Annual Fire Safety Statement (AFSS) certification touchpoint applies if the facility holds an essential fire safety measure. Food premises licensing through the local council interacts with the diagram requirement (the diagram is part of the inspection scope).
- Victoria. Building Act and Fire Services regulations apply, with state-level food premises registration and inspection by the local council.
- Queensland, South Australia, Western Australia, Tasmania, ACT, Northern Territory. Each has its own fire authority inspection program and food premises licensing through local government. Coworking and warehouse-flex facilities follow the underlying building classification rather than food-specific overlay.
- Local council overlay. Many councils require a development approval condition referencing emergency egress for shared kitchens, food halls, or multi-tenant retail. The condition often pre-dates the standard AS 3745 obligation and can be more prescriptive about diagram placement and assembly area location.
